Abstract
This increased demand for disputes settlements mechanisms in construction projects due to different disputes, including breaches of contract, lack of understanding of the terms of the contract, failure to manage the contract and delays in a contract. This research will seek to explore joining the non-signatory third party to an arbitration agreement in construction arbitration in Jordan in comparison to England. Besides, the feasibility of binding non-signatory third party to the arbitration agreement in construction contracts in Jordanian and English arbitration legislation. This research attempts to illustrate the methods of Joining non-signatory third party to an arbitration agreement and its impact on the principles and requirements for a valid construction arbitration agreement as well as the contractual obligations and rights. The research methodology to be adopted in this research is a comparative law analysis methodology. case law, legislation, and arbitral proceedings on the topic will be reviewed and utilised to formulate arguments throughout the research. This research seeks to provide a conclusion and recommendations for the Jordanian legislation as well as for further researches concerning this topic.
